最高人民法院、最高人民检察院《关于办理生产、销售假药、劣药刑事案件具体应用法律若干问题的解释》解读

目的帮助有关人员学习、理解《关于办理生产、销售假药、劣药刑事案件具体应用法律若干问题的解释》法释〔2009〕9号（以下简称《两高司法解释》）,并付诸实践。方法针对这一司法解释出台的背景、法律定位、体系与结构和主要内容进行详细分析、解读。结果与结论《两高司法解释》的颁布和施行,对我国打击生产、销售假劣药品违法犯罪行为提供了法律保障,也将有效地促进药品监管行政执法与刑事司法衔接。对有力打击生产、销售假药、劣药犯罪发挥重要的作用,对生产、销售假药、劣药的犯罪分子产生极大的威慑。

Explanation of "Interpretation of Legal Application Issues Concerning Criminal Cases of Manufacture and Sale of Counterfeit and Inferior Drugs" Released by the Supreme People's Court and the Supreme People's Procuratorate

Objective To help the relevant personnels to better understand Judicial Interpretation by SPC and SPP and put it into practice. Methods To make a detailed analysis and interpretation of background, legal position, structure and content of Judicial Interpretation. Results and Conclusions The promulgation and implementation of Judicial Interpretation by SPC and SPP provided legal guaranty towards combating illegal behavior such as manufacture and sale of counterfeit and inferior drugs, effectively promoting the linking of drug administrative enforcement and judicial adjudication. It played a significant role in combating criminal behaviors of manufacture and sale of counterfeit and inferior drugs, producing a strong deterrent to criminals engaging in illegal druid-related behaviors.
