摘    要:和解在我国是合法地解决纠纷的方式之一。利用和解可以最大程度上消除分歧,达成协定。而且方式灵活,经济便捷,能最大程度上保持纠纷双方的自治性。但和解也具有主观性强,易失公平,容易受多方面原因影响.较难达成,以及法律效率弱,容易反悔等缺点。医疗机构利用和解解决医疗纠纷时,应注意在诚实信用、双方自愿的原则上,采用法定的形式进行,同时应注意其本身的法律要求,在解决医疗纠纷的实际应用中须特别注意的一些事项。

Abstract:Compromise is one of ways dealing with disputes legally in China. It can eliminate bifurcation most and reach pact. It is flexible, easy and economic, and can keep two sides self-ruled. But compromise is subjective, it may be influenced by varieties of factors. While using compromise, medical organization should be based on credit, honesty and freewill, adopted legal way toward law. In actual practice, certain points should be paid more attention.
