阐释《侵权责任法》“医务人员注意义务”的立法宗旨

目的:阐释《侵权责任法》第五十七条的立法宗旨,以使广大医务人员明白医疗过失的判定标准,最大程度地保护患者接受正确、及时诊疗的权益,防范医疗纠纷、和谐医患关系,维护医学事业的发展。方法:通过法律理论,借鉴国外立法情况,结合我国医疗事业实际,解读医务人员在对患者的诊疗过程中,应当履行的抽象注意义务和具体诊疗义务。结果:医务人员在对患者诊疗过程中的抽象注意义务,应当履行"最善的注意义务";医务人员对病人的问诊义务,应当实行严格的判定标准;但是,医务人员对病人诊断和治疗的注意义务,不应当实行严格的判定标准。结论:对医务人员抽象注意过失和问诊是否充分的认定,应当采取严格的判定标准;对医务人员诊断是否正确,治疗是否及时、规范的判定,应当采取谨慎的态度。

Interpretation of "Tort Liability Act": the Legislative Purpose for "Duty of Medical Staff"

Objective： Interpretation of the legislative purpose of Article 57th in ＂Tort Liability Act＂ for the general medical staff to understand the standard of determining medical negligence, in order to protect the maximum right and benefit of patients in receiving the correct and timely diagnosis and treatment, prevent medical disputes, harmonize relations between physicians and patients and maintain medical industry. Methods： Relying on legal theory, referring to foreign legislation, and combining the actual cause of Chinese health care, the medical staff should perform the abstract and concrete treatment obligation in the treatment process. Results： the abstract duty of the medical staff in the treatment course should perform ＂the best goodness duty of care＂; medical staff inquiry duty to patients should be conformed to strict determination criteria; however, the medical staff duty of care for diagnosis and treatment should not follow the strict standard. Conclusion： the abstract medical attention negligence and the inquiry adequacy of medical personnel should adopt strict criteria; it should be taken into considerations whether the medical diagnosis is correct or not, the treatment is timely or not, and the medical determination is standardized or not.
