抑郁症患者凶杀行为及其责任能力的性别差异分析

【目的】探讨抑郁症凶杀患者的人口学和犯罪学特征及责任能力评定。【方法】对天津市1989-2007年精神疾病司法鉴定案例中鉴定为抑郁症凶杀案37例进行了统计和回顾性分析。【结果】在人口学特征（年龄、婚姻状态、职业和文化程度）方面,不同性别间均无显著性差异（P〉0.05）;在犯罪特征和责任能力评定方面,不同性别在杀人类型、造成的后果和伴随自杀方面均无显著性差异（P〉0.05）,但在杀害对象和责任能力方面有显著性差异（P〈0.01）;男性凶杀案的杀人类型与责任能力有显著性差异（P〈0.01）,而女性凶杀案的杀人类型与责任能力无显著性差异（P〉0.05）。【结论】在抑郁症凶杀案的司法鉴定中,应重视凶杀行为的性别差异及性别差异对责任能力评定的影响。

Analysis on gender difference of homicidal behavior and assessment of criminal responsibility in major depression patient

Objective] To study the demographic and criminological characteristics of homicidal behavior in depression patient and responsibility assessment.Method] The data of 37 cases of homicidal behavior with major depression from 1989 to 2007 judged by Tianjin committee of judicial expertise as depression homicidal behavior were retrospectively analyzed.Result] There was no gender difference in demographic characteristics（age,marriage,occupation and cultural degree）（P0.05）.In the aspects of criminological characteristics and responsibility ability,there were no difference in homicidal type,homicidal results and chaperonage results to commit suicide.Whereas significant in the aspects of killing objects（P0.001）and responsibility ability（P0.01）.There was significant difference in homicidal type and responsibility ability in male homicide case（P0.01）,while no difference in female homicide case（P0.05）.Conclusion] In forensic psychiatry testimony,the gender difference should be considered and the effects of gender difference on the assessment to the responsibility ability should also be considered.
