我国社会救助立法研究

社会救助是社会保障体系的重要组成部分，与社会保障的其他部分在维护社会稳定、保障公民人权方面发挥着重要作用。世界上绝大多数国家都建立了完善的社会救助法律制度。我国当前正处于经济转轨和社会结构转型的关键时期，社会结构的变迁可能引起社会不稳定。然而我国传统的社会救助制度却难以担当此任，社会救助制度的不完善已经成为我国经济发展的障碍。因此，必须对现行的社会救助制度进行变革，以法律的形式巩固我国社会救助的法律地位，保障我国社会救助工作的顺利进行。

Social assistance plays an important role in safeguarding the social stability and ensuring citizen human rights as a part of social security.Social assistance combined with other items of social security forms "shock absorber" together in society life.Nowadays social assistance system exists in most countries.During economic revolution and social structure transform in China,the change of social structure possibly cause the social destabilization,will have effect on stability.It has been proved that social assistance is the primary measures to deal with social and economic crisis,especially at the national economic take-off stage,but our traditional social relief can not do so.So,it is necessary for us to take measures for perfecting social assistance system,the standardization of social assistance depends on legislation.
