略论药房托管的性质

全国各地纷纷出现的药房托管模式,是对医药分离政策要求的一种应对。为防止药房托管在实践中的运作出现权利义务不清、责任主体不到位,研究托管合同的法律性质变得很有必要。在分析托管合同双方即医院和药房经营者的权利义务基础之上,可以发现药房托管模式虽然和企业托管、委托合同以及行纪合同有特征类似之处,但只有信托合同制度能更好地兼顾到医院、药房经营者和患者的利益,建议采用信托法规制药房托管。

Brief Discussion on the Nature of Drugstore Trusteeship

A nationwide appearance of drugstore trusteeship mode one after another is a way to cope with the separation policy of outpatient drug department from the hospital.It is quite necessary to study the law nature of trust contracts so as to prevent indistinct relationship of right-duty and inexact liable subject in the process of drugstore trusteeship.On the basis of analyzing the right and duty of both sides-hospital and drugstore operator,it is found that the drugstore trusteeship mode is similar to enterprise trusteeship,contract for commission and contract for brokerage in some characteristics,but only the trust contract system can preferably give consideration to the benefits among hospital,drugstore operator and patient.Therefore,the suggestion is to carry out drugstore trusteeship adopting trust regulations.
