浅谈药品研发技术外包与知识产权问题

目的避免药品研发技术外包中的知识产权纠纷。方法结合中国的《专利法》和《合同法》,剖析了药品研发外包中需要关注的知识产权问题。结果与结论通过提高知识产权保护意识、利用合同规范知识产权的归属和创造良好的知识产权环境等方法,来加强知识产权保护,解决好技术外包中的知识产权问题。

Discussion of Several Issues on Pharmaceutical Contract Research Organization and Intellectual Property

Objective To avoid the disputes over intellectual property rights in the process of pharmaceutical contract research. Methods Based on the Contract Law and the Patent Law of the People＇s Republic of China, a number of issues regarding intellectual property protection arising in the contract research organizations were elaborated. Results and Conclusion By raising the awareness of intellectual property rights, assigning the ownership of intellectual property rights in accordance with the contract and by creating a favorable environment to strengthen intellectual property protection, the disputes related to the contract research can be resolved.
