日本医疗纠纷现状及法律处理评介

20世纪60年代以来，因医患信任关系瓦解，患者权利意识增强，少子化、老龄化社会背景及医疗方协作不足等因素，日本医疗纠纷数量及索赔金额剧增，医疗纠纷处理困难化，日本医师会适时建立依托医师赔偿责任保险的医疗纠纷诉讼外调解体系，处理医疗纠纷，发挥了积极作用。本文对此进行分析，以期对我国医疗纠纷的发展趋势及诉讼外法律处理的研究有所启示。
