法医学鉴定机构不能对涉及临床医学的医事争议案件进行鉴定（上）

在上世纪80年代以前,法医学司法鉴定机构是被禁止介入医事争议案件的,对此司法部曾明文禁止。2003年1月6日,最高人民法院发布了《关于参照〈医疗事故处理条例〉审理医疗纠纷民事案件的通知》后,医事争议案件鉴定的＂双轨制＂正式形成,从此医事案件鉴定便乱象丛生。查所有法律法规,现在关于医疗争议案件的法定鉴定机构,只有《医疗事故处理条例》作出了由市级以上医学会进行鉴定的规定。关于法医师介入医事争议案件的鉴定,也只在《条例》第二十五条中有关于＂涉及死因、伤残等级鉴定的,应当从专家库中随机抽取法医参加专家鉴定组＂的规定,除了此种情形外,没有任何法律有＂法医鉴定机构或法医学鉴定人员可以对医事争议案单独进行鉴定＂的规定。

Forensic Agency Should Not Identified the Medical Disputes Involving Clinical Medicine (I)

Before the 1980＇s, the forensic agency was prohibited from intervening medical disputes, which was in the rules of Ministry of Justice. Since January 6th, 2003, when the Supreme Court issued a ＂Notice on Hearing Civil Cases of Medical Disputes by Reference to ＇Regulations on Handling Medical Disputes＇＂, the ＂dual system＂ was officially formed to investigate those medical disputes, which has aroused a mass of confusion. Among all the laws and rules, only the ＂Regulations on Handling Medical Disputes＂ has such rule that medical disputes should be identified by Medical Association at the city level or above. As to the forensic physician involved into medical expertise, only in Article 25 of the ＂Regulations on Handling Medical Disputes＂ has the relevant regulation that ＂the forensic physician should be randomly selected from a pool of experts to constitute the expert group to identify the medical disputes＂. Except that, there is no any other rule of ＂any forensic agency or forensic physician having a privilege of independently identifying medical disputes＂.great attention.
