| 摘 要： | 对中西行政诉讼举证责任概念以及责任分配规则的异同进行探讨,通过比较分析揭示出行政不作为行为举证责任和行政赔偿举证责任的缺陷,并提出了完善我国行政诉讼举证责任的一孔之见。

| Abstract: | The similarities and differences in the concept of burden of proof and its distribution rule between Chinese and western administrative litigations are discussed. By comparison, the flaws of burden of proof for both administrative nonfeasance and compensation are revealed, and some suggestions for the improvement of burden of proof in administrative litigation are also raised. |
