摘    要:[目的] 探索上海市徐汇区卫生行政处罚的状况,了解行政处罚的有效率,分析产生的原因,并提出对策。 [方法] 对徐汇区2002年277起卫生行政处罚案件进行追踪,有223起有追踪结果。统计间隔时间、行业和案由3个方面对行政处罚有效率产生的影响。 [结果] 1个月内进行追踪案件有效率最高,达97.50%,而大干2个月进行追踪,处罚后有效率最低,为74.42%;生产加工业与食品摊贩的处罚有效率为100%,集体食堂最低,为75.00%;违反健康管理案与生水产品特殊规定案的有效行政处罚最低,分别为86.96%和88.89%。 [结论] 间隔时间越长,有效的行政处罚率越低;不同的案由与行业的有效行政处罚率差异较大。

Abstract:[Objective] To acknowledge the validity of the administration penalty, and provide several ways to improve the utility rates. [Methods] 277 cases of food administration penalty were traced, and 223 cases had the tracing results. The utility rates of administration penalty were calculated from 3 aspects: interval duration, occupation and reason. [Results] The interval duration of the highest utility rate(97.50%) was 1 month, the duration of the lowest(74. 42 %} was more than 2 months; The production and processing industries had the highest utility rate(100%), while the collective refectory had the lowest (75.00% ). The cases that violated the health administration act and special regulation act for raw aquatic production had the lowest utility rate, 86.96% and 88.89% respectively. [Conclusion] The longer the case tracing countercheck, the lower the utility rate of health administration penalty. Different occupations and reasons have different utility rates.
