| 摘 要： | 医疗纠纷的解决与其他纠纷的解决有着许多不同特点；因医疗纠纷而产生的诉讼在法律适用，立案，举证责任等方面存在着与其他诉讼不同的属性，要使医疗纠纷得到公正的解决就必须对医疗纠纷的概念给予准确界定，根据该类诉讼的特点，在法律适宜 和，立案，举证责任等方面作出相应的特殊规定。

| Abstract: | There are many differences between the solution of medical dispute and other disputes. The lawsuit causing by medical dispute is different from other lawsuits in law applying, putting on record, onus probandi etc. We should give the conception of medical dispute a clear definition and give it a special standard in law applying, putting on record, onus probandi according to its characteristics. |
