| 摘 要： | ＂告知后同意＂理论在于最大限度地保障患者福利。该理论构造中的患者权利包括知情权和自主决定权,对应医生负担的一般性告知义务和特殊性告知义务;违反两种不同的告知义务,所导致的责任性质迥异,违反前者,医疗机构应承担行政责任;违反后者,不仅应该承担行政责任,而且应承担民事赔偿责任。

| Abstract: | Informed consent theory aims at protecting welfare of patients at most.Patients＇ rights include to know and to determine by themselves.Accordingly,the physicians burden the duties,that is,general disclosure and special disclosure respectively,which will produce two kinds of different obligations.The former is administrative responsibility;in addition,the latter undertakes both administrative respsnsibility and civil liability. |
