| 摘 要： | 民法作为市场经济的基础法，经济法作为市场经济的主导法，两者构成互补的、有机的市场经济法律体系的理论正为多数学者所接受，回顾“两法”的发展历程，对其历史发展进行分析比较，不但有助于“两法”自身基础理论的完善，而且对“两法”各自功能的充分发挥具有现实意义。

| Abstract: | C, ivil law as the basic law of market economy, and economic law as an independent legal department, are intercomplementary and combined to form the theory of organic market-oriented law system, which is accepted by more scholars. It is helpful to perfect the basic theory of civil law and economic law and bring the function of them into fun play by looking back and comparing their historical development. |
