| 摘 要： | 医生注意义务有其特殊性，其与法律、道德及伦理密切相关，它源自于患者对医生的信赖，正是对这种信赖的保护，法律要求医生承担特殊注意义务。在判断医生注意义务时必须考虑医生专家因素，医疗法律、道德及伦理，医学专业性、医生承担责任的性质等因素，以正确处理医疗损害案件。

| Abstract: | Doctor＇s particularity duty of care related to law, moral and ethics and its origin was patient＇s credit. To protect this credit, laws required doctor to take particularity duty of care. Many factors as well as medical expert, medical law, moral and ethics, professional medical service and the characters of duty were considered to solve medical damage act correctly. |
