Research on Introduction of Patent Linkage and Patent Term Compensation System in China

Objective: To analyze the drug patent protection system and practical experience in the United States, Europe and Japan and to provide references and recommendations for the introduction of drug patent linkage and patent term compensation system in China.Methods: The necessity and feasibility of the implementation of drug patent linkage and patent term compensation system were analyzed by using the methods of literature research and expert consultation.Results: Establishing the patent linkage and patent term compensation system as an major measure to improve drug intellectual property protection system in China is of great significance for encouraging the development of innovative drugs, protecting the rights of innovators, and promoting the balanced development of innovative drugs and generic drugs. The current situation and development direction of the pharmaceutical industry should be fully considered during the system design with the purpose of promoting industrial restructuring and technological innovation.Conclusion: It is necessary to establish drug patent linkage and patent term compensation system suitable for pharmaceutical industrial situation in China as soon as possible.
