知情同意的医学伦理责任

我国《执业医师法》与《侵权责任法》中均明确规定了患者在接受医疗服务过程中享有知情同意权。然而在实际医疗过程中,知情同意仅仅成为了有患者签名的"合同书",为医师提供程序上的保护。为了更好地处理好医学技术与医学伦理二者之间的关系,应从知情同意的伦理学理论、现实意义及伦理学实践中,探究落实患者知情同意权的原则,行使与履行好医患双方的权利与义务,提高医学伦理学的认知与实践。

The Medical Ethics Responsibility of the Informed Consent

The patient’s right of being informed consent are clearly defined in the "Law on Licensed Doctors of the P.R.China" and the "Tort Liability Law of the P.R.China",while receiving medical services.However,in the actual process of medical,this right becames a patient-sign-agreement only,providing doctors with procedural protection.In order to handle the relationship of the medical technology and medical ethics better,we should explore the implementation of patient’s right of being informed consent principle,exercise and fulfill the rights and obligations of both doctors and patients,improve medical ethics cognition and practice,based on being informed consent ethical theories,practical significance and ethical practice.
