| 摘 要： | 同性恋是一个敏感的话题(至少在中国),同性恋者广泛分布在世界的各个国家之中。作为人类的一分子,同性恋者应当享有和异性恋者同样的权利,这是国际人权的必然要求。世界各国对同性恋的态度和做法大相径庭,但目前很多西方国家已经形成了保护同性恋权益的法律。可以说,加强对同性恋权益的保护,是尊重和捍卫人权的必然要求,是大势所趋。而同性恋者在当代中国的地位并不明朗,1997年修改后的刑法虽没有明确禁止同性恋行为,但也没有任何一部法律承认同性恋者的地位。中国作为一个在国际上越来越多的展现自我之国家,更应该顺应历史潮流,正视同性恋问题,积极保护同性恋者的权益,以此来展现一个尊重人权的民族之伟大风貌。
