| 摘 要： | 随着改革开放的不断深入，我国的经济和社会发展都取得了长足的进步，同时医疗卫生事业也取得了重大进展，但近年来，医患关系不断恶化，已经成为影响我国构建和谐社会的一大因素。本文从分析我国医患关系紧张的法律原因入手，具体分析我国存在的医患法律关系，医疗纠纷的法律适用等法律问题，提出以保护医患双方利益为目的、重构和谐医患关系的法律新机制。
