| Abstract: | In recent years,compensation in cases of medical malpractice was a rising trend.Medical violation becomes a focus of controversy between doctors and patients.Medical violation constitutes of the two elements of medical behavior and illegal acts by the health care,and it can be divided into deed and nonfeasance.Justify of medical offense is that,although the medical staff implemented of the right to against the patient,the medical staff＇s behavior is legitimate,and thus the tort liability of medical personnel be removed. |
