《侵权责任法》中药品缺陷的法律责任

医疗侵权属现代侵权法所调整的侵权行为类型之一。《侵权责任法》对医疗侵权责任的归责原则做出了新的规定,即医疗损害责任一般实行过错责任原则,特殊情形下适用过错推定原则和无过错原则,从而形成了科学完整的医疗侵权责任归责原则体系,有利于保护医患双方合法权益。在司法实践中,医疗侵权归责原则仍然存在适用上的问题需要解决。本文简单探讨了《侵权责任法》在医疗产品质量缺陷问题中归责原则及举证责任、法律适用等方面仍然存在的问题,力图通过本文讨论分析在实务中明确药品缺陷的法律责任,希冀引起人们更多的关注,给医师一个相对宽松的执业环境,营造一个良好的医患环境。

The legal liability of drug defect in the tort liability law

Medical tort will be regulated by modern tort law.The principle of liability fixation on medical tort in tort liability law is changed.Generally,by medical damage is regulated by fault liability principle and also regulated the principle of presumption of fault and no fault principle in special circumstances.Thereby,a scientific and completion medical tort liability fixation system is shaped and is benefit for protecting patient and hospital rights.In practice,there are still problems on legal adaption when imputation.Problems on principle of liability fixation,burden of proof,law adaption in tort liability law on medical quality defect are discussed.The legal liability of drug defect is heavily discussed to attract more attention on publics and build harmonious hospital patient environment.
