| 摘 要： | 并发症发生的原因实际上是非常复杂的,疾病因素,主体、客体因素和社会因素常常交错存在,必须具体而实事求是地分析原因,界定责任。对于并发症在法律上应考虑以下思路:不可避免的并发症——自然无责;难以避免的并发症——风险免责;可以避免的并发症——过失负责。

| Abstract: | Actually, the causes of complications are very complex. The factors of diseases, subject, object and the society often crisscross. Analysis should be done to find the reason precisely and realistically, to define the liability. The liability about complications in the legal view can be divided into unavoidable complications - natural irresponsibility, irritable complications - risk liability exemption, and avoidable complications - fault liability. |
