论反垄断法对知识产权滥用行为的规制

知识经济时代,知识产权滥用导致的垄断问题成为市场垄断的重要方面,尤其是跨国公司滥用知识产权谋求垄断利益,已经给我国经济安全带来威胁。我国第一部《反垄断法》已颁布施行,但这部“经济宪法”对有关知识产权滥用的反垄断问题没有作出细致的规定。知识产权与反垄断法的关系及知识产权滥用的反垄断法后果是基本的理论问题,而理论与操作中的关键问题都是“知识产权滥用”的界定,这些有待于相关细则的出台。

On Regulations of Abuse of Intellectual Property Rights by Antimonopoly Act

In this time of intellectual economics, the monopoly induced by abuse of intellectual property rights has become an important aspect of market monopoly which is threatening economic safety of our country. The first Antimonopoly Act of China has already carried out, however, it lacks detailed regulations of antimonopoly problems concerning abuse of intellectual property rights.
