无陪护病房面临的法律及纠纷问题探讨

目的:了解患者对陪护的需求及无陪护期间可能涉及的法律和纠纷问题。方法:参考有关文献和《侵权责任法》自行设计住院患者陪护需求调查表,抽样调查某日住院患者200例,了解患者对陪护的需求以及无陪期间涉及法律问题时的态度。结果:患者对陪护的需求较高(68.5%),54.5%的患者及家属对无陪护期间患者病情变化及意外情况不予接受,46.5%的患者家属表示无陪期间患者发生紧急情况时不愿意医院擅自处置,存在法律及纠纷隐患。结论:住院期间亲人陪护是中国亲情文化的需求,无陪护病房存在一定的法律及纠纷隐患,应因地制宜,按需控制陪护,满足患者需求,规避医疗及法律风险。

Exploration of the legal problems and disputes of the ward without accompanying.

Objective：To explore the needs of patients on accompanying and legal problems and disputes without accompanying.Methods：200 patients were surveyed the needs of accompanying and legal problems and disputes without accompanying by ＂accompany demand for inpatient questionnaire＂.Results：The needs of patients on accompanying was higher（68.5%）,the changes of patients condition without accompanying will not accepted by 54.5% % of the patients and their families.46.5% of patients and their families thought there are legal and dispute risk without accompanying.Conclusion：There are legal and dispute risk without accompanying,so hospital should avoid the mdical and legal risks by controling the need of acompany and meeting the need of patients.
