《医疗事故处理条例》的立法缺陷及其完善

《医疗事故处理条例》实施以来，其在医疗事故预防、医疗事故鉴定、保障患者合法权益等方面发挥了十分积极的作用，这有利于我国医疗立法的发展和完善。但是，随着时代的发展，《医疗事故处理条例》在实践中的法律缺陷也越来越明显，这主要体现在其对于医疗事故责任制度，医疗事故鉴定制度的规定以及所引发的反向歧视的问题上。笔者从这些缺陷出发，就相应的完善措施进行了探讨，希望能促进我国相关立法的进一步完善与发展。

Legislative Defects and Measures of the Regulation of Medical Malpractice

Since the implementation of the Regulation of Medical Malpractice,it has played an active role in medical malpractice prevention and identification,and protection of patients’ legitimate rights and interests,which is helpful to the development and improvement of healthcare legislation.However,with the development of the times,legal deficiencies of the Regulation of Medical Malpractice have become more and more obvious in practice,mainly reflected in the medical liability system,the medical malpractice identification system and the issues of adverse discrimination.Based on these defects,this article explores some measures to promote the further improvement and development of relevant legislation.
