| 摘 要： | 文章通过对现阶段医患关系的主流争议的介绍、医疗活动的性质及相关法律的分析，认为我国医疗纠纷的处理应根据医患双方的法律属性确定医疗纠纷的性质以及医院、医生、患者及政府部门在医疗纠纷中的责任。

| Abstract: | This paper give a brief introduction that disputes of the law relationship between doctors and patients, nature of the medical activity and analysis of the relevant law of the present stage in China. It is think that the medical dispute treated should be according to the doctors-patients' legal attribute, and attribute to the responsibility of the hospitals, doctors, patients and government department in the medical dispute. |
