论H省医院评鉴暨医疗质量监管中心的法律性质及其与卫生行政部门的关系

赋予H省医疗质量监管中心民办非企业单位法人资格的主张在法律与实践上均不可行,民办非企业单位这一法律性质也无法确保其医疗质量监管工作的公正性和有效性。卫生行政部门目前以科层制方式管理监管中心一方面有其法理上的依据,另一方面也是囿于公法人治理结构、绩效管理合同等相关制度缺失时的必然选择。这一问题其他转轨国家同样存在,但是科层制固有的缺陷在构建医疗质量监管体系时必须加以警惕。从长远来看,赋予监管中心公法人资格,并建立有效的治理结构和监管制度是处理监管中心法律性质及其与卫生行政部门关系等问题的必由之路。

On Hospital Accreditation and Medical Quality Regulation Center's Legal Nature and Its Relations with Health Authorities in H Province

Labeling H Province＇s Medical Quality Accreditation Center as non-profit organization is infeasible in the respects of law and practices.The legal nature as NPO can＇t ensure that the center＇s regulation of medical quality is both impartial and effective.Health authorities has the legal basis to control the center with bureaucratic mode.And health authorities now have to control the center with no choice but bureaucracy for the lack of concerning institutions,such as public legal entity＇s corporate governance and administrative performance-based contract.There exist the similar problems in other transition countries.But more attention should be paid on the inherent disadvantages of bureaucratic mode.In the long run,granting Medical Quality Accreditation Center the qualification of legal persons and establishing the efficient governance structure and supervision structure is the only way of solving the problems of the law nature of supervision center and the relationship of health administrations.
