| 摘 要： | 在医疗活动中紧急救治权与知情同意权的冲突现象有其产生的理论和现实根源,单纯地谴责医务人员不履行紧急救治的行为无助于冲突的解决。应从法律和伦理两方面入手诠释冲突产生的原因。完善相关法律的实施细则、明确特殊情况下医院及医务人员的权利与义务、规范知情同意书内容、规范医疗机构医学伦理的决策管理是避免及减少冲突的有效途径。

| Abstract: | During medical activity,there are theory and realism spring of that the right of emergency treatment is in conflict with the right of informed consent.Simply investigating responsibilities is of no avail to solve the conflicts.To Interpret the real reasons of the conflict through legal and ethical aspects.To avoid and reduce conflict,the effective measures are that perfecting the rules of relevant law,elucidating the rights and obligations of hospital and medical staff;regulating the contents of informed consent form and strengthening medical ethics education. |
