| 摘 要： | 医疗行业是高风险行业，医学技术是在不断发展和提高的，医疗事故的发生有其必然性。医疗事故的赔偿，必须考虑依法维护医患双方的权益，依法有据，合情合理，建立有限赔偿制，追偿制和推行医疗职业保险制度，这是卫生改革的需要，医患双方的要求，也是市场经济发展的必然。

| Abstract: | Medical profession is a high-risk profession and malpractice is inevitable. Malpractice compensation must safeguard the legal rights of doctor and patient based on proof and fairness. Establishing limited compensation system and recovery system, and carrying out medical profession insurance are not only requirements of health reform, but also demands of doctor and patient. It is necessity of development of economic market. |
