《化妆品卫生监督条例》罚则的适用与操作的合理衔接

探讨《化妆品卫生监督条例》其罚则章节的适用及操作性的合理衔接。本着有利于保持化妆品卫生法制管理的连续性与稳定性的原则，针对化妆品生产经营企业迅速发展所面临新的公共卫生问题，对适当调整适用范围并强化监督力度，力求与相关行政法律法规相衔接，规范卫生行政执法。提出：现行的《化妆品卫生监督条例》其罚则章节的规定缺乏可操作性和应有的威慑力。建议，要建立具有中国特色的社会主义卫生法制体系，必须加强卫生改革与卫生法制建设，使卫生法理论在实践中不断完善。

Reasonable link of The Application and Operation of Penalty Regulations in "Cosmetic Health Supervision Regulations"

This paper is aimed to explore reasonable link of the application and operation of penalty regulations in ＂Cosmetic Health Supervision Regulations＂. With the principles of keeping the continuity and stability of the jural administration on cosmetics health, facing to the new public health issues produced by the rapid development of cosmetics enterprises, the scope of the application of the ＂Cosmetic Health Supervision Regulations＂ should be adjusted and the surveillance should be strengthened to ma~e it complied with relative laws and regulations, and to normatively implement the health administration. Provisions of sections of penalty regulations in the present ＂Cosmetic Health Supervision Regulations＂ are lack of Operability and proper deterrent. To build the socialistic health legal system with Chinese characteristic, health reform and health legal construction should be strengthened to make health legal theory continuously improve in practice.
