用法律保护医疗卫生人员、促进和谐医患关系

伤医事件是医患矛盾的极端行为,除了运用法律手段维护医护人员、严惩少数犯罪人员外,我们应该反思一下医患矛盾形成的原因,从根本上来预防和缓解中国的医患矛盾。笔者用经济学的原理阐明病人和医生的关系是主体和代理的关系,医患双方的信息是不对称的。从供方角度应加强医德教育,培养与患者的沟通技巧,保护患者的尊严、隐私、保密、自主权;从需方角度要树立正确的健康观和生死观,尊重医生人格尊严,理解自己是健康的第一责任人。影响医患信任的因素还有伦理、政治和医疗保险制度等。我国《基本医疗卫生与健康促进法》的通过为未来建立包容和谐的医患关系提供了法律的保障。

Protecting medical health personnel and promoting harmonious doctor-patient relationship by Law

Medical staff’ s injury event is extreme behavior in conflicts between doctors and patients. In addition to using legal means to maintain the practice safety of medical staff and severely punish a small number of criminals,we should think about the causes of the underlying reasons for the doctor-patient conflict,and fundamentally prevent and alleviate the doctor-patient conflict in China. The author uses the principle of economics to explain that the relationship between the principle( patients) and agent( doctors),and the asymmetric information between doctors and patients. From the perspective of the supplier,we should strengthen the medical ethics education,cultivate communication skills with patients,and protect patients’ dignity,privacy,confidentiality and autonomy;From the perspective of the demander,we should establish a correct view of health,life and death,respect doctors’ personal dignity,and understand that patients play a role of first personal responsible for their own health. There are also having ethical,political and medical insurance system factors that affect the doctor-patient trust. The adoption of" Basic Health Care and Health Promotion Law"in China will provide legal guarantee for the establishment of inclusive and harmonious doctor-patient relationship in the future.
