| 摘 要： | 食品药品行政处罚案件法制审核制度是行政机关内部法制监督制度,是由法制机构或法制人员对执法机构的执法行为进行合法性及合理性审核的制度。笔者通过实证研究、比较研究等方法对食品药品监管行政处罚法制审核权的主体、性质、运行程序及效力等问题进行分析,以促进此类行政处罚案件法制审核制度的完善。

| Abstract: | The legal examination system of administrative penalty for food and drug administration is the system of legal supervision within the administrative organ,reviewing on the legality and rationality of law enforcement agencies conduct by legal agencies or Legal personnel.Through the methods of empirical research and comparative study,this paper analyzes the system,property,operation procedure and validity of the legal examination power of administrative punishment for food and drug administration by empirical method and comparative study so as to promote the improvement of the legal reviewing system of administrative penalty cases. |
