| 摘 要： | 目的探讨评定精神病性精神障碍患者责任能力初、复鉴中的影响因素及其分歧产生的原因。方法对68例复鉴精神病性精神障碍患者的资料进行相关分析和逐步判别分析,筛选出对责任能力评定有重要影响的判别因子,然后对初、复鉴结果的一致性进行检验。结果影响责任能力评定的判别因子中,初鉴有作案动机和突然性、作案时诊断和行为障碍,复核有作案前先兆、作案的突然性和方式、自我保护能力和思维障碍,存在差异。作案动机(k=0.417)、思维障碍(k=0.295)及责任能力(k=0.326)等方面的一致性评定也存在差异。结论精神病性障碍责任能力初复鉴评定中存在一定分歧,有必要开发出一套操作性和科学性较强的评定规范,以提高鉴定的客观性和准确性。

| Abstract: | ObjectiveTo analyze the potential effect factors of responsibilities assessment in cases of psychotic disorder.MethodsThe numerical data of 68 cases were carried out with spearman correlation analysis and stepwisely discrimination analysis by using SPSS11.0 software, then the identified factors on responsibility assessment were selected and the consistencies between the previous assessment and re assessment were analyzed.ResultsSignificant differences existed between previous assessment and reassessment on rating of motivations, diagnoses, and legal responsibility conclusion. ConclusionPotential deviations exists in the forensic psychiatric assessment,and it is necessary to develop a set of evaluating regulations to improve the objectivity of forensic assessment. |
