| 摘 要： | 医疗责任保险市场需求的增加,带动医疗责任保险市场的兴起。但是,医疗责任保险格式条款没有 约定保险人抗辩义务,将不利于该险种的长期发展和保险功能的实现。文章提出应当以诚实信用等原则为法理 基础,具体约定保险人的抗辩义务。
