我国医药知识产权保护现状与对策

通过收集相关机构和数据库统计数据并对其进行二次分析,发现医药专利保护力度相对不足,医药专利的职务发明相对较少,医药企业自主研发新药较少,医药商标的申请和注册量均较少,中药品种保护的作用重要。建议提高医药专利和商标的申报意识和质量水平;建设专业的知识产权管理队伍;加大科技创新,提高企业自主知识产权水平;充分利用和发挥中药品种保护的作用。

Status and Countermeasures Study of Protection of Medical and Pharmaceutical Intellectual Property in China

Collecting statistical data through the relevant agencies and databases and making secondary-analysis.The result suggest the protection of pharmaceutical patent is inadequate;Pharmaceutical patent inventions during the work are relatively small;Independent research and development of new drugs are short in the field of pharmaceutical production;Pharmaceutical trademark applications and registrations are relatively small in China;The effect of Protection of Types of Traditional Chinese Medicine is great.We should improve the awareness and the quality of pharmaceutical patent and trademark reporting;build a contingent of professional management of intellectual property;intensify scientific and technological innovation,raising the level of enterprises’ independent intellectual property rights;make full use of and give play to the role of traditional Chinese medicine variety protection.
