| 摘 要： | 文章从法律的独特视角审视与构建和谐医惠关系,系统分析和设计了在医患关系建立之前、医患关系存续期间和医患纠纷产生之后三个阶段的法律措施.医患关系建立之前和医患关系存续期间的法律措施主要是为了预防医患纠纷的产生,包括完善法律制度、培养法律意识、加强法治化管理、准确认识和把握双方的权利、义务及法律地位等,而当医患纠纷不可避免的产生之后,则积极主动采取调查、成立医事仲裁庭、进行非诉讼和诉讼等各种法律对策予以解决,以实现医患关系的协调、统一,逐步走向和谐.
