《侵权责任法》对药品不良反应法律责任的影响

目的探讨《侵权责任法》实施后对药品不良反应侵权责任的法律适用及法律责任带来的影响。方法运用文献研究的方法、案例研究的方法、归纳等逻辑研究的方法,研究《侵权责任法》的法律规定。结果证明了常见且可预期之外的药品不良反应是药品缺陷,发生药品不良反应侵害时,药品生产者、销售者和医疗机构应当承担侵权责任。结论确定药品不良反应侵权责任时,应当区分不承担责任和减轻责任的情形,同时要对关键细节进行司法解释以明确法律责任,也可以更好地体现《侵权责任法》的立法宗旨。

The impact of the Tort Liability Act on the tort liability of adverse drug reactions

Objective To study the impact of the Tort Liability Act on the application of law and the tort liability of adverse drug reactions.Methods The major study methods used in this paper included literature research,cases study,induction and so on,to study the legal provisions of the Tort Liability Act.Results The unusual and unexpected adverse drug reactions were due to drug defect was proved. Once adverse drug reactions happen,drug manufacturers,drug distributors and medical institutions should take liability for tort.Conclusion When the tort liabilities of adverse reactions are determined,the distinction between irresponsibility and mitigated responsibility should be drawn,while judicial interpretation of key details should be mede to clear the legal responsibilities and better reflect the legislative purpose of the Tort Liability Act.
