处理医患关系的双刃剑——由举证责任倒置引发的思考

举证责任倒置就患者而言体现公平，就医院和医生而言则要在医疗工作中提高法律意识。然而，面对目前仍以经验科学为特点的医学科学，使用举证责任倒置会不会使医护人员向未知领域探索的积极性被消解在不断的法律诉讼之中；由于我国法律尚无枉诉的规定，举证责任倒置虽大大降低了患者状告医院的门槛，但会不会导致某些人滥用诉权和恶意诉讼的发生。这些问题值得关注。作为体现社会公平与正义的法律，应从医学科学的特点和实际出发，站在促进医学科学发展和社会进步的高度，确立一个能最大限度地保护医患双方合法权益的平衡点。

The Double-edged Sword of Improving the Relation between Doctors and Patients- A Thought Derived from the Inverse Responsibility in Offering Evidences

The inverse responsibility of offering evidences,in the patients′ part,means fairness while the doctors and the hospitals should heighten their legal awareness while engaging themselves in the medical work.However,the inverse responsibility of offering evidences makes the medical workers′ enthusiasm lost in the constant lawsuits because nowadays medical science is still bearing the characteristics of empirical science.We should notify the fact:Can the inverse responsibility of offering evidences be abused in lawsuits and the malicious lawsuits often occur since there is no regulation about wrong accusation in our law,which makes it easier for the patients to charge hospitals.As we have a fair and justifiable law,we should do everything according to the characteristics and realistic situation of medical science;we should try to improve medical development and social advancement;we should try,in the greatest extent,to create a balance so as to protect doctor′s and patient′s interest.
