| 摘 要： | 国际上对传统医药知识保护问题的提出产生于科学技术的发展对文化多样性和生物多样性的破坏。现行知识产权制度在鼓励科学进步的同时也形成了新的利益不平衡;保护传统知识（传统医药）已经发展成为许多国际组织谈判的重要议题,国内立法是促进传统医药知识保护国际进程的重要一环。

| Abstract: | Internationally, the question of traditional medical intellectual protection is raised because of the disruption of scientific and technical development to cultural and biological diversity. Current intellectual property system is promoting the progress of science, but also bringing about new imbalance of interests. Traditional medical intellectual protection has become the important issue of many international organizations. Domestic legislation plays an essential role in promoting the international advance of traditional medical intellectual protection. |
