| 摘 要： | 随着医疗科学技术的不断发展，骨科植入医疗器械作为治疗骨科疾病的一种有效手段，正越来越多地用于临床。但是，植入医疗器械作为新型材料性治疗像其他治疗措施一样，也会发生一定的不良反应，由此引起的法律纠纷也日益增多。笔者对此类纠纷进行了分析，指出了医疗机构的6种举证不能，及应采取的相应措施。

| Abstract: | With the development of medical science and technology, the medical instrument of orthopedic transplantation, as an effective method of treating orthopedic diseases, is more and more used in medical practice like other medical treatment, However, the transplanted medical instruments as a new type material treatment can also cause some side effect which resulted in legal disputes increasing. The author analyses these kinds of disputes and indicates six aspects of evidences that cannot be taken by medical agencies, also point out suitable measures to be taken. |
