| 摘 要： | 现行知识产权法上所规定之权利的要素,具有主体明确、客体专有及期限性的特征.传统中医药知识不完全符合这些特征.但是,从法理上分析,以现行知识产权法上的权利要素特征,作为判断传统中医药知识能否受到知识产权法保护的标准的观念,是不正确的.传统中医药知识具有可知识产权性.

| Abstract: | The elements of rights stated in the active Intellectual Property Law(IPL) have the characters of specific principal part,proprietary object and time limit.The traditional Chinese medicines and therapies knowledge are not in accordance with these characters.However,by analysis based on nomology,it's not a right concept to judge whether the knowledge can be protected by the IPL with the elements characters of rights in the active IPL.The traditional Chinese medicines and therapies knowledge have the ability to obtain intellectual property. |
