医疗诉讼举证责任倒置后医院面临的问题及对策

我国最高人民法院2002年4月1日起施行的《关于民事诉讼证据的若干规定》第四条第八款:明确患者将不再承担对医疗行为与损害结果及医疗过程有无差错的举证责任,而由掌握相关的证据材料的医疗单位承担,即实行举证责任倒置。因此,医院面临着诸如医务人员认识上存在差距、医院管理滞后等问题。笔者经过观察与思考,提出了解决这些问题的切实可行建议和对策,希望能与广大同行进行探讨。

The Problems and the Preventive Measures for the Performance of Onus Proof Conversion in Medical Litigation

The law- Some Stipulation of Civil Litigation Testimony - issued by the Supreme Court of the People's Republic of China has been applied into practice since Apr1 2002. The Article stipulates that, for medical disputes, the hospital which conserves the medical record should be the provider of the evidences which manifest whether the accident is caused by medical behaviors or process. The article challenges the hospitals greatly; also, there are some defects in the hospital management. In order to resolve these problems, some recommendations and resolutions are proposed in this article
