规范患者授权委托书填写的思考

在医患矛盾日益尖锐的今天,患者知情同意权的维护及医务人员告知义务的履行则显得尤为重要.知情同意权作为患者的一种民事权利,可经合法的授权行为,委托他人代理行使.临床实践中,主要体现为,患者签署授权委托书,将其诊疗过程中相关权利,特别是知情同意权转移给被委托人,被委托人将代理委托人行使委托权限内的权利.有效的授权委托可以更好地维护患者权益,更有利于诊疗过程的顺利进行,但现行的授权委托书存在诸多问题,笔者就实践中发现的问题进行思考并提出改进建议,以期规范授权委托书的填写.

Thought on the Standardization of The Filling of The Letter of Authorization of Patients

The safeguard of the informed consent right of patients and the carrying out of obligation to disclose ef medical work- ers were especially important in the condition of poignant contradiction between doctors and patients today. As a kind of civil right, informed consent right can be entrusted to others by legal act of authorization, such as the filling of the letter of authorization, which can transfer the rights of the patients, especially informed consent right to the mandatary to perform the rights within the scope of au- thority. Effective authorization letter can protect the rights and interests well and promote the process of treatment. But there were many problems existing in the current authorization letter, so the author provided some advices for development after long time of practice, so as to standardize the filing the authority letter.
