生产销售假药案行刑衔接面临的问题与解决途径

目的：建议完善生产销售假药案行刑衔接工作。方法：从药监部门案件移送有待改善、公安机关立案困难有待解决、检察机关监督力度有待提升三个方面分析现在生产销售假药案行刑衔接工作存在的问题，从假药的定义、入罪标准、法律规定、证据互认机制、药监体制方面找出其中原因。结果与结论：建议修订假药定义，组建假药司法鉴定机构，提高相关规定法律位阶，明确各部门分工和衔接程序，以此完善生产销售假药案件行刑衔接工作。

On the Connection of Execution for Production and Sale of Counterfeit Medicines in Crime Judicatory

Objective:To improve the connection of execution for production and sale of counterfeit medicines in crime judicatory. Methods:The problems of the connection of execution for production and sale of counterfeit medicines in crime judicatory were analyzed from the three aspects:the transfer of cases from the drug regulation department, the difficulty of filing the cases in the public security organization and the supervision by the procuratorial agency. The reasons were explored in the definition of counterfeit medicines, standard of incrimination, legal provisions, mutual recognition of evidence, as well as in the drug supervision system. Results and Conclusion:It is proposed that the definition of counterfeit drugs be revised, judicial verification agency for counterfeit medicines be established, the legal level of relevant regulations be raised, and the division and linking procedures among various departments be made clear so as to improve the connection of execution for production and sale of counterfeit medicines in during crime judicatory.
