| 摘 要： | 随着国家对科学发展观的实施和推进,药物专利的申请与保护已经成为药物研发单位与生产企业在激烈的市场竞争中的重要战略,中药作为中国独有的一门医药学科在专利申请与保护上具有自身的特点。文章从一名中药专利审查员的角度出发,对中药专利申请在申请过程中容易出现的问题与容易导致被驳回的原因作一列举,并向申请人提供相应的对策,同时针对申请文件的撰写提出相关建议。

| Abstract: | Application and protection of pharmaceutical patents has become an important strategy of the drug R & D unit and production enterprises in the fierce competition with the promote of scientific outlook on development.Traditional Chinese medicine as a unique medical discipline has its own characteristics in the patent application and protection.On the viewpoint of a TCM patent examiner,some problems in process of application and courses of rejection are to be explained,and the appropriate countermeasures and recommendations of the application documents writing be provided in this paper. |
