| 摘 要： | 目的：探讨现有药品集中招标采购中存在的法律问题。方法：案例研究法与理论探讨相结合进行分析。结果：现有药品集中招标采购制度的法律地位存疑，且主体错位，政策不能形成完整体系。结论：在四中全会提出推进全面依法治国后，我们应当完善药品集中招标采购，做到医药改革有法可依。

| Abstract: | Objective: Analysis of legal problems exist in drug concentrated bidding and purchasing system. Methods: case study and literature review. Outcomes: There are no strong evidence shows that the existing drug concentrated bidding and purchasing system is legally effective. Subjects of the system are wrongly defined. The policy system of drug concentrated bidding and purchasing is not systematic. Conclusion: The legal problems exist in drug bidding and purchasing systems should be tackled properly. Pharmaceutical Reform should be conducted based on relevant laws. |
