涉嫌暴力违法被鉴定人责任能力的多因素分析

目的探索涉嫌暴力违法被鉴定人责任能力的相关因素。方法采用回顾性研究方法,在2008～2010年的鉴定案例中筛选出符合研究条件的案例共178例进行主成分分析、相关分析和逐步回归分析,并结合相关文献进行讨论。结果责任能力与因子1(行为认知能力)、辨认能力、控制能力、医学诊断、因子2(作案行为)、因子3(负荷双方关系、危害对象、对案件性质的认识)、委托单位、送鉴原因、精神病史相关。回归分析显示,责任能力与家族史、送鉴原因、因子1高度相关,三者可解释责任能力的67.5%的变异。结论涉嫌暴力违法被鉴定人责任能力的评定存在许多影响因素,与以往研究基本相同,因此有必要制定统一的责任能力鉴定标准。

Analysis on responsibility of violent criminal suspects

Objective To explore the factors relative to responsibility of violent criminal suspects. Method A retrospective study of 178 cases which were selected from cases between 2008 to 2010 were expressed,and the statistical methods included principal component analysis,correlation analysis and stepwise repression analysis. Results Responsibility had a significant relation with factor 1（cognitive behavioural ability）,ability of identification,ability of control,medical diagnosis,factor 2（acts of crime）,factor 3（relationship of each load,victim,understanding to character of case）entrust organization,reasons of commission and histrory of mental illness.Resultes of regression analysis showed history of mental illness,reasons of commission and factor 1 were highly relevant to responsibility,which could explain 67.5% of the variation. Conclusions Responsibility assessment of violent criminal suspects was affected by many factors,which was consistent with previous findings.So uniform standards of responsibility assessment should be formulated essentially or possibly.
