医疗事故民事责任的有限赔偿说

医疗事故责任历来是纠纷中医患双方关注的焦点，医院强调一次补偿，患者要求巨额赔偿，作者认为二者均存在着认识上的误区，不心符合民法原则，邦联提出痦秘事责任的有限赔偿说，即患者因其承担了部分的医疗费用的支出而在医疗事故的民事责任的处理时享有部分赔偿权利，院方因其自筹了部分医疗经费（存在一定的赢利）而在医疗的民事责任处理时承担部分的赔偿义务。

A Theory of Limited Compensation about the Civil Liability of Medical Negligence

The civil liability of medical negligence are always the focus of the conflicts between medical institutions and patients. The medical institutions emphasize on the compensation once for all, which could hardly meet the patient's great demands. In the author's opinion between both sides there is a understanding mistake which is not conform with the doctrine of the civil law. Thereby, a theory of limited compensation is put forward according to this problem. On one side, the patients have part right of the compensation for they have paid a certain amout for treatment. To the other side since the hospitals get a sum from medical treatment with interest, they must bear part obligation of comp ensation in handling civil liability of medical negligence.
