| 摘 要： | 从我国医疗纠纷的处理现状出发,分析现有医疗纠纷处理机制与方法,即当事人和解制度、行政调解制度和诉讼制度的优点与缺点。运用机制设计理论,提出从防范医疗纠纷发生、明确医疗纠纷责任、理顺医疗纠纷各方权益、完善医疗纠纷处理路径等方面,建立与完善多元化的医疗纠纷处理应对体系。

| Abstract: | In this paper,departure from the status quo of medical malpractice, a comparative analysis of existing medical dispute resolution mechanism and methods,proposed to prevent the occurrence of medical malpractice, clear the responsibility of the medical malpractice, straightening out the rights and interests of the parties to the medical dispute, and improve the medical disputes by using mechanism design theory and methods to establish and improve a wide range of medical disputes response system. |
