| 摘 要： | 没收物品的处理没有明确规定。通过对没收物品处理中的问题和缺陷的分析,提出了没收物品处理应遵循的五项基本原则,并进一步探讨了推进没收物品处理法的理论研究和立法进程、建立没收与处理权分离机制、健全没收物品的处理程序和方法等三项措施。

| Abstract: | There is not obvious regulation about how to deal with confiscated materials.Through analyzing the problems and defects of dealing with confiscated materials,this paper put forward five basic principles that should be followed during dealing with confiscated materials,and discussed the three measures as following:(1) pushing forward theoretical research on regulation of dealing with confiscated materials,and legislative process;(2) establishing the mechanism that separated right of confiscating and right of dealing with;and(3) perfecting the procedure and methods of dealing with confiscated materials. |
